GENERAL TERMS AND CONDITIONS OF SALE
 

1. GENERAL INFORMATION



These General Terms and Conditions of Sale ("GTCS") apply to all sales made through the Canadian online store of Caran d'Ache (the "Canadian e-Boutique"), jointly operated by Caran d’Ache SA and Morton Clarke & Co. Ltd.

Morton Clarke is responsible for order fulfillment, invoicing, customer service, and regulatory compliance for Canadian consumers.

Caran d’Ache SA (Chemin du Foron 19, CH-1226 Thônex-Genève, Switzerland) (“Caran d’Ache”) is the sole owner of the Canadian e-Boutique and is responsible for the platform's technical infrastructure and secure operation.

For clarity, you are entering into these GTCS with Morton Clarke, the contractual seller. You are invited to read the GTCS carefully before placing an order. To order a product or service on the Canadian e-Boutique, acceptance of these GTCS is required.

You must have reached the legal age of majority in the province or territory in which you reside to place an order, unless your parent or legal guardian agrees to these GTCS and places an order on your behalf.

These GTCS may be amended at any time and are always accessible on the Canadian e-Boutique.

 

2. PERSONAL DATA



The personal information collected when you access and order a product on the Canadian e-boutique is jointly controlled by Caran d’Ache SA and Morton Clarke.

You retain the right to refuse the sending of emails, invitations or commercial communications from Morton Clarke and/or Caran d’Ache at any time, when you first register on the Caran d’Ache website and thereafter.

For any further information relating to the collection, processing, and disclosure of your personal information by Caran d’Ache, please read Caran d'Ache's Privacy Policy.

 

3. SALES PROCESS


 

3.1. ORDERS



Once you select the desired product using the “Add to basket” button, it will be placed in the shopping cart. You can then continue your selection of items, modify your shopping cart or continue the order process and proceed to check out.

The product presentation does not constitute a binding offer, but an invitation to place an order.

By clicking on the “Confirm my order” button, you place an order for the products listed on the order page.

By confirming your order, you confirm that you have accepted out GTCS.

Once you have validated and paid for your order, it can no longer be changed (including a change in the engraving for personalized instruments or a change in the delivery address).

You will then receive confirmation of your order by e-mail.

The sales contract only comes into force if the shipment of the goods is confirmed by e-mail (shipping confirmation) or at the latest by delivery of the goods.



3.2. PRICES



Prices are in Canadian dollars (CAD) and include or clearly indicate applicable taxes (GST, PST, HST, or QST). The delivery expenses for the order are indicated during the order process.

Prices and other fees published on the Canadian e-Boutique can be modified without prior notice and at any time. However, you will be invoiced for the products on the basis of the prices in force at the moment of the confirmation of the order.

 

3.3. DEPICTION OF THE PRODUCTS



The products and services sold through the Canadian e-Boutique are depicted by photographs with the highest possible accuracy. However, due to the mode of presentation of these products on the Internet network, it is possible that the perception of the customer of the photographic depiction of the products does not exactly correspond to the products themselves.

 

3.4. PAYMENT



Payments may be made via credit card or via PayPal. The payment cards accepted are: Visa, Master Card, and American Express.

In accordance with applicable legislation, Caran d’Ache and Morton Clarke do not memorise your banking data. It is therefore up to you to save and print the certificate of payment if you wish to preserve the details of the payment related to your order.

The management of payments made on the Canadian e-boutique complies with the PCI DSS (Payment Card Industry Data Security Standard) certification. This international norm, set up by the main market actors (MasterCard, Visa, American Express, Discover Financial Services and JCB) stipulates the security requirements for international payments:
 
  • Setup and management of a secured network
  • Cardholders data protection
  • Maintain a vulnerability management program
  • Application of efficient measures of access control
  • Continued surveillance and frequent network tests
  • Establishment of a privacy policy

 

3.6. ASSOCIATED SERVICES



Except for small products and accessories (cartridges, inks, diary refills), the products proposed for sale on the Canadian e-Boutique may include complimentary gift-wrapping materials within the package for customers to wrap the items themselves. This associated service is not automatic, you are responsible for ticking the option you want in the shopping basket, before paying for your order.

For the Writing instruments sold through the Canadian e-Boutique, we offer Writing engraving for $20 and Fine Writing engraving for $40 (except on mentioned special occasions), within the limits of the technical possibilities for each given product (dimension and position of the free space, font choice).

We reserve the right to refuse any order for products with personalization containing terms or words that are contrary to the law, inappropriate, and-or insulting.

Customized (engraved) products cannot be exchanged or refunded.

The prices displayed on the Canadian e-Boutique may be modified without notice and at any time. However, you will be charged for the services on the basis of the rates in force at the time of validation of the order.

If you have a promotional code, it will not apply to engraving, which is a service, unless specifically stated.

 

3.7. GIFT CARD


 

3.7.1. PURCHASING A GIFT CARD


The Caran d’Ache gift card is only available in non-material format, i.e. in PDF format, that you can then download and print out.

When purchasing a gift card, you have the possibility of personalising it by indicating the name of the sender and of the beneficiary and adding a personalised message. Caran d’Ache reserves the right to refuse any messages containing inappropriate or insulting language that is contrary to the law or to Caran d’Ache policy. You must select one of the gift card amounts proposed. You cannot choose any amount you wish.

The gift card cannot be refunded, even partially, and cannot be resold or exchanged.

As the gift card is a non-material product, no postage charge will be applied to the purchase.

No discount code can be applied to the gift card.

Purchase of a gift card requires specific processing and must be completed individually.

This will prevent you from adding other products to a basket containing a gift card. You cannot order several gift cards at the same time. Again, we invite you to place a separate order.
 

3.7.2. USING A GIFT CARD
 

The gift card can only be used on the Canadian e-Boutique. It cannot be used in physical stores or on our online course platform, Creative Class. It is not possible to use a gift card to purchase another gift card. The gift card must be used in the country where it was purchased.

If a gift card is lost or stolen, it will not be refunded.

The gift card is a payment method. To use the amount corresponding to your gift card, you must enter the code indicated on the PDF sent by e-mail and the security code. If the total cost of your order is greater than the amount on your gift card, the remaining amount must be paid using one of the other payment methods proposed. You cannot use several gift cards for the same order: only one card will be accepted for payment of an order.

 

3.8. DELIVERY



Products are delivered to the address provided by the customer during the order process.

Starting from the order and the confirmation of payment, the times of delivery, given here on an indicative basis only, are as follows:
 
  • 5 business days for standard products;
  • 2 to 3 weeks for personalized products;
  • 4 to 5 weeks for certain specific products (estimated shipping times for these products are also indicated on the relevant product pages);

 

3.9. RIGHT OF WITHDRAWAL - PRODUCT RETURN AND REFUND



You have a right of withdrawal, i.e. the right to return the delivered product within 14 days of receipt of the product in return for a refund of the purchase price of the product (excluding the return costs which remain at your expense). Exchanges of products are not possible.

The refills (cartridges, inks, agenda refills) as well as the engraved products (Fine Writing and Writing Instruments) cannot be returned or refunded. Only the products bought through the Canadian e-Boutique and returned intact (in their original package) may be refunded.

The procedure for returning the goods is as follows:
 
  • You log in to the Caran d’Ache website to make a return request via your customer account.
  • Once the return request has been submitted, you will receive an email with detailed instructions on how to complete the return process.
  • You send the goods, at your expense, to the following address: Morton Clarke 107-669, Ridley Place, Delta, BC, V3M-6Y9

 

3.10. WARRANTY IN CASE OF DEFECT



Every Caran d’Ache product comes with a guarantee against defects in workmanship or material. The guarantee does not cover the following cases:
 
  • the usual maintenance;
  • defects and damage due to failure to follow maintenance instructions;
  • defects and damage due to regular wear and tear;
  • defects and damage resulting from misuse, negligence or accident;
  • defects and damage due to improper use, modification, customisation, repair, dismantling or service by a person who has not received official approval from Caran d’Ache;
  • defects and damage caused by use of inks or refills or components other than those recommended by Caran d’Ache;
  • defects and damage relating to loss, theft or any other cause beyond the control of Caran d’Ache;
  • defects and damage to any Caran d’Ache writing instrument whose serial number has been altered.

All Caran d’Ache products are covered by a 2-year international guarantee from the date of purchase. You have the option of extending the guarantee period to an additional three (3) years of your Haute Ecriture products free of charge (i.e. five (5) years of warranty in total by creating an account on the Website. Fine Writing instruments manufactured before July 2020 keep the lifetime guarantee (if delivered with the old user manual - international guarantee).

The Caran d'Ache guarantee is exclusively limited to the repair of the products, or their replacement when no repair is possible or certain parts are no longer produced, to the exclusion of any refund or compensation. Products that cannot be replaced by identical products are exchanged for products of the same value and, as far as possible, of similar design.

 

3.11. CUSTOMER SERVICE AND REPAIRS

 

The customer may contact the Canadian e-boutique Customer Service for any request for information or for repair. In the event of positive feedback from Customer Service following a repair request, you will be invited to send them your product at your expense:
 
  • Integrally: body, cap, writing block;
  • With a duly completed, signed and dated warranty certificate, or with a copy of the purchase invoice;
  • Accompanied by a written description of the problem encountered;
  • Indicating your exact address for the return of the product.

After examination by the Customer Service:
 
  • If the repair is covered by the guarantee, the product is automatically repaired and sent back to you free of charge;
  • If the repair is not covered by the guarantee, the Customer Service shall provide you with an estimate.

The necessary time to perform the repair shall be announced by the Customer Service on a case-by-case basis.

 

4. APPLICABLE LAW & JURISDICTION



These GTCS are governed by the laws of the province of the consumer's residence.

 

5. LANGUAGE



In accordance with the Charter of the French Language, all contractual documents will be provided in French and English.

In case of discrepancy between the English and French versions of these GTCS, the version in the language chosen by the consumer at the time of purchase shall prevail.
